1. Introduction and Acceptance of Terms

Welcome to Sentinel & Wellness ("we," "us," "our," or "the Company"). These Terms and Conditions ("Terms") govern your access to and use of our website located at sentinelwellness.co.za (the "Website") and our services, including the purchase of books and health products (collectively, the "Services").

By accessing or using our Website or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Website or Services. These Terms constitute a legally binding agreement between you and Sentinel & Wellness.

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website or Services after such changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

2. Definitions

In these Terms, unless the context indicates otherwise, the following words and phrases shall have the meanings assigned to them: "Customer" or "you" means any person who accesses or uses the Website or Services; "Products" means any books, health products, or other items offered for sale on the Website; "Order" means a purchase order placed by a Customer through the Website; "Payment Gateway" means any third-party payment processing service used to facilitate transactions, including but not limited to Paystack and EFT (Electronic Funds Transfer); "Website" means the Sentinel & Wellness online platform accessible at sentinelwellness.co.za and all associated pages and subdomains.

3. Eligibility and Account Registration

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

While account registration is not required to browse our Website, you may be required to create an account to place Orders. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account at any time if we suspect fraudulent, abusive, or illegal activity.

4. Products and Services

We offer a variety of books and health products through our Website. All Products are subject to availability. We reserve the right to discontinue any Product at any time without prior notice. Product descriptions, images, and specifications are provided for informational purposes only and may not be entirely accurate or complete.

We make every effort to display Products accurately, including colors, images, and descriptions. However, we cannot guarantee that your computer monitor's display of any color will be accurate. Product images are for illustrative purposes only and may not reflect the exact appearance, size, or condition of the Product.

We reserve the right to refuse or cancel any Order for any reason, including but not limited to Product availability, errors in pricing or Product information, or suspected fraudulent activity. If we cancel your Order after payment has been processed, we will issue a full refund to your original payment method.

5. Pricing and Payment

All prices displayed on the Website are in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) where applicable, unless otherwise stated. Prices are subject to change without notice, but we will honor the price at the time you place your Order.

We accept payment through various methods, including credit and debit cards processed through our Payment Gateway (Paystack), and Electronic Funds Transfer (EFT). By providing payment information, you represent and warrant that you are authorized to use the payment method and that the payment information is accurate.

For EFT payments, Orders will only be processed after we receive confirmation of payment. You are responsible for ensuring that payment is made to the correct bank account and that the correct reference number is used. Payment must be received within 3 business days of Order placement, or the Order may be cancelled.

All payments are processed securely through our Payment Gateway providers. We do not store your complete payment card information on our servers. By using our Payment Gateway, you agree to be bound by the terms and conditions of the Payment Gateway provider.

If payment is declined or fails for any reason, your Order will not be processed. We are not responsible for any fees charged by your bank or payment provider in connection with your payment.

6. Orders and Acceptance

When you place an Order through our Website, you are making an offer to purchase Products at the prices and on the terms stated on the Website. We reserve the right to accept or reject your Order for any reason.

Your Order is not accepted until we send you an Order confirmation email. The Order confirmation email will contain your Order number, Order details, and estimated delivery date. If you do not receive an Order confirmation email within 24 hours of placing your Order, please contact us.

We reserve the right to limit the quantity of Products purchased per person, per household, or per Order. These restrictions may apply to Orders placed by the same account, the same credit card, or Orders that use the same billing or shipping address.

If we are unable to fulfill your Order for any reason, we will notify you and provide a full refund if payment has been processed. We are not liable for any indirect or consequential losses arising from our inability to fulfill an Order.

7. Delivery and Shipping

We deliver Products throughout South Africa. Shipping costs are calculated at checkout and are clearly displayed before you complete your Order. Standard shipping within South Africa is charged at a flat rate of R 150.00 per Order, unless otherwise stated.

Delivery times are estimates only and are not guaranteed. We aim to process Orders within 1-2 business days after payment confirmation, and delivery typically takes 3-7 business days within South Africa, depending on your location. Total delivery time is typically 4-9 business days from Order confirmation.

You are responsible for providing accurate delivery information. We are not responsible for delays or non-delivery caused by incorrect or incomplete delivery information provided by you. If a Product is returned to us due to incorrect delivery information, you will be responsible for any additional shipping costs.

Risk of loss and title to Products pass to you upon delivery to the carrier. We are not responsible for any loss or damage to Products after they have been delivered to the carrier. If you receive damaged Products, please contact us immediately.

8. Returns and Refunds

We want you to be completely satisfied with your purchase. You may return Products within 14 days of delivery, provided that the Products are in their original condition, unopened, and with all original packaging and tags attached.

To initiate a return, you must contact us at returns@sentinelwellness.co.za or through our contact form, providing your Order number and reason for return. We will provide you with a return authorization number and return instructions. Return shipping costs are the responsibility of the Customer, unless the Product is defective or we sent the wrong item.

Refunds will be processed within 5-10 business days after we receive and inspect the returned Product. Refunds will be issued to the original payment method used for the purchase. For EFT payments, refunds will be processed via bank transfer to the account from which payment was received.

We reserve the right to refuse returns that do not meet our return policy requirements. Products that have been opened, used, damaged by the Customer, or returned after the 14-day period are not eligible for return. Personalized or custom-made items, and digital products, are not eligible for return unless defective.

9. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Sentinel & Wellness or its content suppliers and is protected by South African and international copyright and trademark laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent, except as permitted by applicable law.

The Sentinel & Wellness name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sentinel & Wellness or its affiliates. You may not use such marks without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Sentinel & Wellness, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Website or Services.

Our total liability to you for all claims arising from or related to the use of the Website or Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or R 1,000.00, whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable South African law.

11. Privacy and Data Protection

We are committed to protecting your privacy. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our Website or Services, you consent to the collection and use of your personal information as described in our Privacy Policy.

We comply with the Protection of Personal Information Act, 2013 (POPIA) and other applicable South African data protection laws. We will only use your personal information for the purposes set out in our Privacy Policy and will not sell or rent your personal information to third parties.

You have the right to access, correct, or delete your personal information at any time by contacting us. We will respond to your request within a reasonable time frame as required by applicable law.

12. Prohibited Uses

You agree not to use the Website or Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Website or interfere with any other party's use of the Website. Prohibited uses include, but are not limited to, attempting to gain unauthorized access to the Website, transmitting any viruses or malicious code, or using automated systems to access the Website without our permission.

You may not use the Website to collect or harvest personal information about other users, or to send unsolicited commercial communications. Any violation of this section may result in immediate termination of your access to the Website and Services, and may subject you to civil and criminal penalties.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the Website or Services shall be subject to the exclusive jurisdiction of the courts of South Africa.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

14. Dispute Resolution

In the event of any dispute or claim arising out of or relating to these Terms or your use of the Website or Services, you agree to first contact us to seek an amicable resolution. We are committed to resolving disputes fairly and efficiently.

If we are unable to resolve the dispute through direct communication, you may refer the matter to the Consumer Goods and Services Ombud (CGSO) or another appropriate dispute resolution body in South Africa, as applicable.

Nothing in this section prevents you from seeking urgent relief from a court of competent jurisdiction where necessary to protect your rights or prevent irreparable harm.

15. Consumer Rights

These Terms do not affect your statutory rights as a consumer under the Consumer Protection Act, 2008 (CPA) or any other applicable South African consumer protection legislation. You have the right to receive goods that are of good quality, in good working order, and free of defects.

If a Product is defective or does not conform to the description provided, you have the right to return the Product and receive a full refund or replacement, as provided by law. Our return policy is in addition to, and does not replace, your statutory rights.

16. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or telecommunications failures, or the failure of third-party service providers, including Payment Gateway providers.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and Sentinel & Wellness regarding your use of the Website and Services, and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Sentinel & Wellness.
